1. Acceptance of These Terms

These Terms of Use govern your access to and use of pelonkey.com and any pages, content, forms, or features made available through the website (collectively, the “Site”). The Site is operated by Pelonkey, Inc., a Washington, D.C. corporation (“Pelonkey,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

 

2. Site Information Is Not an Event Services Agreement

The Site provides general information about Pelonkey, our services, and selected work. Site content, inquiry responses, preliminary conversations, availability statements, and estimates do not create a binding obligation to provide services. Event services are governed only by a separate written agreement signed or accepted by Pelonkey and the applicable client.

 

3. Permitted Use

You may use the Site for lawful personal or business purposes related to learning about Pelonkey or contacting us. You may not:

  • Copy, reproduce, republish, sell, license, or commercially exploit Site content without written permission.
  • Interfere with Site security, availability, performance, or functionality.
  • Attempt to gain unauthorized access to the Site, its systems, or information submitted by other users.
  • Use automated tools to scrape, harvest, or extract Site content or data except as permitted by applicable law or our written authorization.
  • Submit false, misleading, unlawful, infringing, harmful, or malicious material.
  • Use the Site in a manner that violates applicable law or the rights of another person or organization.

 

4. Intellectual Property

The Site and its content—including the Pelonkey name and logos, text, photographs, videos, graphics, concepts, experience descriptions, case studies, design elements, and other materials—are owned by or licensed to Pelonkey and are protected by intellectual property and other laws. No right or license is granted except the limited right to access and use the Site under these Terms.

 

5. Inquiries and Submissions

When you submit an inquiry, brief, idea, attachment, or other material through the Site, you represent that you have the right to provide it and that it does not violate law or another party’s rights. You retain ownership of your materials. You authorize Pelonkey to use them as reasonably necessary to evaluate and respond to your inquiry, recommend services, prepare proposals, and communicate with you. Submitting an inquiry does not require either party to enter into a business relationship.

 

6. Portfolio and Third-Party Materials

Project descriptions, photographs, client names, venue names, and third-party marks may be included for informational portfolio purposes. All third-party names and marks remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.

 

7. Third-Party Services and Links

The Site may link to or integrate third-party services, including scheduling, social-media, analytics, video, mapping, and form-processing services. Pelonkey does not control those services and is not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms and policies.

 

8. No Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Pelonkey disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, security, and uninterrupted availability. We do not warrant that every service, performer, vendor, concept, or event element shown on the Site is currently available.

 

9. Limitation of Liability

To the fullest extent permitted by law, Pelonkey and its officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from or related to the Site. To the fullest extent permitted by law, Pelonkey’s total liability arising from or related to the Site will not exceed one hundred U.S. dollars (US $100). These limitations do not apply where prohibited by law.

 

10. Indemnification

You agree to defend, indemnify, and hold harmless Pelonkey and its officers, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms, or material you submit through the Site.

 

11. Privacy and Cookies

Our Privacy Policy explains how we collect, use, and disclose personal information. Our Cookie Policy explains how the Site uses cookies and similar technologies. Both policies are incorporated into these Terms by reference.

 

12. Changes to the Site or These Terms

We may update the Site or these Terms from time to time. The updated Terms will be posted with a revised effective date. Your continued use of the Site after an update means you accept the revised Terms.

 

13. Governing Law and Venue

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law principles. Any dispute arising from or related to the Site or these Terms must be brought exclusively in the state or federal courts located in the District of Columbia, and you consent to their jurisdiction.

 

14. General Terms

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pelonkey regarding use of the Site and do not replace a separate client services agreement.
